enqu Referral Programme | Terms and Conditions

These Terms and Conditions ("Terms") govern participation in the enqu Referral Programme operated by Jacob Benyon T/A enqu ("we", "us", "our").
1. Eligibility
- 1.1. The Programme is open to our existing clients with one or more completed project(s) with us ("Referrers").
- 1.2. Participation is optional and free of charge.
- 1.3. We reserve the right to verify eligibility and refuse participation at our discretion.
2. What qualifies as a referral
- 2.1. A "Referral" occurs when a person or organisation ("Referred Client"):
- (a) is introduced to us directly by a Referrer OR passively though a Referrer's website developed by us, and
- (b) is not an existing or previous client, and
- (c) enters into a paid contract with us and completes payment for their first project in full.
- 2.2. Referrals must be submitted/made known to us before the Referred Client makes their first enquiry or proposal with us.
- 2.3. Only one Referrer may claim a reward for a Referred Client. If multiple referrals are received for the same lead, the first recorded will apply.
3. Referral reward
- 3.1. For each valid Referral, the Referrer will recieve £45 ("Reward").
- 3.2. Rewards are paid within 30 days after the Referred Client's first project has been paid for in full.
- 3.3. Rewards are issued as a bank transfer, at our discretion. As an alternative Reward, you may request £65 as credit against future services.
4. Exclusions
- 4.1. Referrals of the Referrer's own business, subsidiaries, affiliates, or companies under common ownership control are not eligible.
- 4.2. No Reward is payable if:
- (a) the Referred Client cancels, or
- (b) the Referred Client fails to pay, or
- (c) the Referred Client's project is terminated before payment, or
- (d) the Referrer has breached these Terms.
- 4.3. Rewards are not transferable or exchangeable for other services or benefits unless agreed in writing.
5. Payment
- 5.1. Where the Referrer is a business registered for VAT, a valid VAT invoice must be provided before payment.
- 5.2. Individuals are paid gross; the Referrer is solely responsible for declaring any income or tax obligations arising from the Reward.
- 5.3. Payments will be made to a UK bank account or by such other method as we agree in writing.
6. Relationship of the parties
- 6.1. Participation in this Programme does not create any employment, partnership, agency, or joint venture relationship between you and us.
- 6.2. You have no authority to act on our behalf or to make representations about our services.
7. Relationship
- 7.1. We will handle all personal data in accordance with UK data protection law and our Privacy Policy.
- 7.2. We will not disclose details of the Referred Client's project or payment status beyond confirming whether a Referral has qualified for a Reward.
8. Programme changes
- 8.1. We may amend, suspend, or withdraw the Programme, or change these Terms, at any time without notice.
- 8.2. Any changes will apply to referrals made after the updated Terms are published on our website.
- 8.3. Rewards already earned before a change takes effect will be honoured.
9. Limitation of liability
- 9.1. We will not be liable for any loss, damage, or expense arising out of or in connection with participation in this Programme, except for liability that cannot be excluded by law.
- 9.2. Our total aggregate liability under these Terms shall not exceed the total Reward paid or payable for the relevant Referral.
10. Governing law
- 10.1. These Terms are governed by and construed in accordance with the laws of England and Wales.
- 10.2. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising from or relating to the Programme.
